Biography

Eric Aitken is a partner at Dennis James Aitken LLP with a focus on commercial litigation. He acts regularly as counsel in complex corporate-commercial matters, including contractual claims, shareholder actions, fraud claims and professional negligence cases. Eric also acts for clients in administrative and regulatory matters and has acted in proceedings before the Securities Commission, Health Professions Review Board and the Association of Professional Engineers and Geoscientists.

Eric has appeared before all levels of court in British Columbia and has acted for clients in both domestic and international arbitrations.

Before joining Craig Dennis, K.C. and Owen James as founding partners at DJA Counsel, Eric practiced at an international law firm and spent six years at another commercial and securities litigation boutique in Vancouver. Eric began his legal career as a law clerk for six justices of the British Columbia Supreme Court.

Craig Dennis, K.C., Owen James and Eric Aitken succeeded for the plaintiff in obtaining a multi-million dollar damages award
The award related to a fraudulent investment scheme carried out by the defendants. The underlying litigation involved claims based in fraud, conversion and breach of trust. The award concluded litigation that saw the plaintiff obtain a worldwide Mareva Order to freeze the defendants’ assets at the outset of the litigation as well as obtain (by working alongside foreign counsel) an order recognizing and enforcing the order in Hong Kong. In the course of the proceeding Craig, Owen and Eric were also successful in obtaining orders that the defendants be held in contempt of court.

Eric Aitken, acting alongside Robert Cooper, K.C. of McEwan Partners and Nicholas Hooge at Farris Vaughan Wills & Murphy LLP, were successful for the respondent developer.

The British Columbia Supreme Court rejected an application brought by the court-appointed Receiver to complete 40 pre-sale purchase contracts. The court sided with the developer and the secured creditors in holding that in light of the substantial increase in market value of the 40 units, it was appropriate to direct the Receiver to disclaim the contracts and take immediate steps to remarket and sell the units.
