Trusts, or alleged trusts, can arise in a variety of ways: expressly, by statute or by other operation of law. Issues arising from business succession planning and inter-generational wealth transfer have led to an increase in litigation over trusts and other equitable concepts, such as unjust enrichment.

DJA lawyers have been involved in leading cases in these areas at the trial and appellate levels, arising both from corporate disputes and family law claims (see, for example, Re Bison Properties Ltd., 2018 BCSC 1299).

We have a deep understanding of the law of trusts and equity generally and are equipped to offer strategic legal representation in relation to trust claims whether involving the existence of a trust, the duties of trustees or the rights of beneficiaries.
