Biography

Andrew Mollard is an Associate at the firm and a dual‑qualified lawyer admitted to practice in both Canada and the United States. He acts as counsel in complex commercial litigation, with a practice focused on class actions, breach of contract, torts, civil forfeiture, and property and leasing disputes.

Andrew brings a multidisciplinary perspective to commercial litigation, drawing on his advanced training in economics and his experience representing clients on both sides of the “v”. Prior to joining DJA Counsel, he worked at an international firm in Vancouver and spent several years in the New York office of a leading global litigation firm, where he developed extensive experience in high‑stakes multidistrict class actions and “bet‑the‑company” litigation, including notable antitrust and securities matters.

His representative experience includes defending major U.S. beef and pork producers in multidistrict antitrust litigation and representing a class of investors in a stock‑lending antitrust matter that resulted in a settlement of more than $580 million. Andrew has also acted in significant trial matters, including serving on a trial team in a failed COVID‑related merger and acquisition material adverse event claim in the Delaware Court of Chancery, as well as expedited proceedings regarding voting practices in Pennsylvania.

Andrew has additional experience in litigation involving the real estate and forestry industries. Most recently in British Columbia, he defended a logging client in an arbitration concerning helicopter logging practices, and he has represented property owners in real estate disputes involving breach of restrictive covenants, flooding and water damage, leasing issues, and regulatory compliance under the Short‑Term Accommodations Act.

Earlier in his career, Andrew served as a judicial law clerk to Justices Anne MacKenzie and John Hunter at the British Columbia Court of Appeal.

  • In re Stock Lending Antitrust Litigation (S.D.N.Y.) — Represented a class of institutional investors and hedge funds alleging that major Wall Street banks conspired to block the development of exchange‑based trading in the stock‑lending market. The team secured a USD $580‑million cash settlement, along with significant injunctive reforms, following successful class‑certification proceedings.
  • Snow Phipps Group, LLC v. KCake Acquisition, Inc. (Del. Ch.) — Represented a private‑equity client in one of the few COVID‑related material‑adverse‑event (MAE) disputes to proceed to trial in the Delaware Court of Chancery. The team obtained a trial ruling in the client’s favour, compelling the defendant to close its USD $550‑million acquisition.
  • Donald J. Trump for President v. Boockvar (M.D. Pa.) — Represented intervenor‑defendants in an expedited suit brought by the Trump election campaign, the Republican National Committee, and several Members of Congress concerning voting practices in Pennsylvania.
